1. Agreement to Terms

By accessing or using MoonBro ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you do not have permission to use the Service.

These Terms apply to all users, including group administrators, supervisors, and community members interacting with the bot.

2. Description of Service

MoonBro provides AI-powered Telegram bot services for cryptocurrency communities, including but not limited to:

• AI-powered chat moderation and community management
• Token price tracking and alerts
• Knowledge base management and RAG-powered responses
• Spam and scam detection
• Community analytics and engagement features
• Multi-language support

3. Account Registration

To use certain features of the Service, you must have a Telegram account. You are responsible for:

• Maintaining the security of your Telegram account
• All activities that occur under your account
• Ensuring your use complies with Telegram's Terms of Service

4. Subscriptions and Payments

4.1 Free and Paid Tiers

MoonBro offers free and paid subscription tiers. Features and limitations vary by tier as described on our pricing page.

4.2 Billing & Payment Methods

Subscriptions are billed monthly or annually as selected. We accept the following payment methods:

• Credit/Debit Cards: Processed securely through Stripe (Visa, Mastercard, American Express, etc.)
• Paddle: Alternative payment processor supporting cards, PayPal, and regional payment methods
• Telegram Stars: Pay directly within Telegram using Stars (subject to Telegram's policies)
• Cryptocurrency: ETH, BNB, SOL, and USDC via NOWPayments (available for Pro and Enterprise tiers)

All fees are non-refundable except as described in our Refund Policy below or as required by law. Prices are displayed in USD unless otherwise specified.

4.3 Credit System

Some features use a credit-based system. Credits:

• Are non-refundable once purchased
• Do not expire while your account is active
• Cannot be transferred between accounts
• May not be exchanged for cash

4.4 Cancellation

You may cancel your subscription at any time. Access continues until the end of the current billing period.

4.5 Refund Policy

We want you to be satisfied with MoonBro. Our refund policy is as follows:

• Subscriptions: We offer a full refund within 7 days of your first subscription purchase if you are not satisfied. After 7 days, subscriptions are non-refundable but you may cancel at any time.
• Credit Purchases: Credits are non-refundable once purchased, as they are immediately available for use.
• Cryptocurrency Payments: Due to the nature of blockchain transactions, all cryptocurrency payments are final and non-refundable.
• Telegram Stars: Refunds for Telegram Stars payments are subject to Telegram's refund policies.
• Service Issues: If you experience significant service outages or technical issues that prevent you from using features you paid for, contact us at info@moonbro.biz and we will work with you to resolve the issue or provide appropriate compensation.
• Chargebacks: If you initiate a chargeback without first contacting us, your account may be suspended pending investigation.

To request a refund, email info@moonbro.biz with your Telegram username and reason for the request. Refunds are processed within 5-10 business days.

5. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Promote or facilitate illegal activities
• Distribute harmful, abusive, or hateful content
• Engage in market manipulation or securities fraud
• Transmit malware or engage in phishing
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to systems
• Impersonate others or provide false information
• Harvest user data without consent
• Circumvent any rate limits or restrictions

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you upload to the Service (knowledge base documents, FAQs, etc.). By uploading content, you grant us a limited license to use, process, and display that content to provide the Service.

6.2 Our Intellectual Property

The Service, including its design, features, and code, is owned by MoonBro Inc. and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.

7. AI-Generated Content

The Service uses AI to generate responses. You acknowledge that:

• AI responses may not always be accurate or complete
• AI should not be relied upon for financial, legal, or medical advice
• You are responsible for reviewing AI-generated content before acting on it
• We are not liable for decisions made based on AI responses

8. Cryptocurrency Disclaimer

MoonBro is not a financial advisor. Information provided about cryptocurrencies is for informational purposes only and should not be construed as investment advice.

• Cryptocurrency investments are highly volatile and risky
• Price data and alerts may be delayed or inaccurate
• We do not guarantee the accuracy of any token information
• You should conduct your own research before making investment decisions

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We reserve the right to:

• Perform maintenance with or without notice
• Modify or discontinue features at any time
• Temporarily suspend service for security or operational reasons

10. Termination

We may suspend or terminate your access to the Service at our discretion, including for:

• Violation of these Terms
• Abuse of the Service
• Non-payment of fees
• Request by law enforcement

You may delete your account at any time through the dashboard or by contacting support.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OF INFORMATION

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONBRO INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits or data
• Business interruption
• Financial losses from trading decisions

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless MoonBro Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Service

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after changes constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
